Government Action: BBB reports on known government actions involving business’ marketplace conduct:
State of Michigan v. AmeriGas
The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government's allegations, which have not yet been proven.
On June 27, 2018, the Michigan Attorney General's Consumer Protection Division (MI-AG) filed a complaint against AmeriGas Partners, L.P., for violating the Michigan Consumer Protection Act, and to recover damages for the company's alleged deceptive and unfair practices.
Specifically, the lawsuit accuses the company of grossly inflating prices, charging unnecessary fees and failing to deliver promised services. The lawsuit also alleges the company no longer refunds Michigan customers who return propane after terminating service. Instead, the suit alleges the company resells the returned propane to other customers and keeps the money for itself.
The MI-AG further claims the company allowed 20-30 Michigan consumers served by one of its subsidiaries to run out of propane in the winter of 2015-16, even though the company was responsible for filling the tanks as part of an auto-fill program. The lawsuit further alleges the company charged a HazMat and Fuel Recovery fee on propane deliveries in Michigan. According to the lawsuit, the company mislead Michigan consumers into believing that these non government-mandated fees are needed to cover overhead expenses, which are already paid for through per-gallon pricing.
The lawsuit further states that the company was in breach of a 2014 settlement agreement regarding excessive per-gallon prices on propane during the winter months, and its marketing statements were false and misleading regarding fixed-price contracts, free tank installation and early termination fees.
The MI-AG asks the court to find the company in violation of the law, permanently enjoin it from violations in the future and seeks restitution, injunctive relief, civil penalties, and reimbursement of the Michigan's costs and expenses of investigation.
